Is intended for use where there is a clear and concise description/brief of the Services the Consultant is required to deliver. It is drafted to be straightforward to use with Consultant and Client obligations set out at in its first two clauses and to fairly balance the rights and obligations of the parties, the intention being to encourage clients acceptance of this "user friendly" Standard Form.
The Schedule to the Agreement enables the Consultant to set out the basis on which fees and expenses are to be paid. The Schedule also provides for any limit of liability or exclusions to be stated as well as the amounts of public liability and professional indemnity insurance.
The Agreement can be used in relation to BIM projects, requiring the parties to comply with their respective obligations set out in any BIM protocol referred to in the Schedule. Notes to the Schedule highlight that a clear description of the Services the Consultant is required to deliver and their intended use should be provided with clear definition of project objectives.
The ACE Short Form, which is suitable for use in Scotland, is intended to have particular application to small and medium sized projects and offers a useful addition to the current ACE Agreements.
